Which day the clock started

Anyone who has opened a liquidated damages assessment knows this. It lands late in the job, with a list, a sum and a deadline counted in days. Every line rests on a date and a clause, and the dates are where it goes wrong.

One case on our Try page: a city's $284,000 assessment on a path and transit stop job. Yesper went through it against the Special Provisions and the punch list record. The correction periods were counted from the walk-through instead of from receipt of the written punch list. Yesper's recalculation comes to $28,550.

You know what to concede, what to dispute and which ground to lead with, inside the protest window, not at final payment. Same for the neighbouring jobs on the Try page: claims from site diaries, change orders missing from the log, a final pay application checked line by line.
