Summary

Out of scope

11 comments carry 37% of the resolution hours

A detention facility sized for the 100-year storm (K-057, 64 hr), a roundabout at Depot Street (K-030, 56 hr) and a new bus stop (K-270, 42 hr) are outside the scope of services. The 11 new requirements account for 287 of 772 hours, or $55,965 at $195/hr.

Action: request written authorization for additional services before starting the work.

Superseded criteria

14 comments cite Design Criteria Memo Rev. 2

All 14 come from reviewer MK (City, drainage) and call for storm sewer and curb inlets along the path from Sta. 29+70 to 57+90. Rev. 3, adopted at Design Coordination Meeting 5 (item 6) on Apr 14, 2026, calls for a vegetated swale. Treated as design corrections, they would mean 46 unpaid hours against the current criteria.

Action: ask the owner to confirm that Rev. 3 governs.

Duplicates

29 comments repeat the same 12 issues

City and ODOT reviewers flagged the same items, such as the top-of-wall elevation at Sta. 53+00 (K-207 with three duplicates) and the settlement estimate at Sta. 27+10 (K-244 with three). Counted separately, resolution time would be 64.5 hours higher.

Action: respond once per issue and point the duplicates to that response.

    Method

    1. Both comment files were read row by row. Each comment was tied to its reviewer, sheet or report page, and station.
    2. Each comment was checked against the scope of services (Exhibit A), the Design Criteria Memo (DCM) Rev. 3 and the decisions in the minutes of Design Coordination Meetings 1–8.
    3. Design correction: the plans conflict with the scope, the design criteria or our own design data. Under the agreement’s technical accuracy clause, the engineer corrects deficiencies in technical accuracy without additional compensation unless they are directly attributable to deficiencies in owner-furnished information. Clarification: the plans are correct and the reviewer asks why. Unclear criteria: owner-furnished information is missing or conflicting. Out of scope: the work is outside Exhibit A and needs the owner’s written authorization as an additional service.
    4. Comments on the same issue were grouped. Hours are counted once, on the first comment in the group.
    5. Resolution hours were estimated per comment from the number of affected sheets and the extent of the change, 0.25 to 64 hours. Dollar values are hours × $195.

    Assumptions and limitations

    • Hours are estimates per comment. Knock-on revisions between disciplines are not estimated.
    • Hours for unclear criteria assume the owner adopts what the reviewer proposes.
    • Dollar values for design corrections and clarifications show the value of the time inside the lump sum. They are not billed.
    • Additional services that require written authorization should be authorized before work starts.
    • The categories are proposed responses for the comment resolution matrix. Changes made on this page are not saved.
    • Dollar values use the agreement’s $195/hr rate. That rate, and the set-up with ODOT reviewing as highway owner on a City-led project under an EJCDC E-500 agreement, should be confirmed by the project manager against the executed agreement and ODOT’s local agency procedures.
