Summary

Section by section

12 of 208 provisions differ in substance

All three front ends are built on the Town's 2025 contract template and carry the same 208 provisions. 157 are identical and 39 differ only in project data or wording. The 12 substantive differences cover contract time, liquidated damages, payment and bonding.

Don't price B and C on A's assumptions.

Intermediate contract time · LDs

ICT No. 1 on NC 410 carries $2,500 a day in liquidated damages

A week late costs $17,500 on B against $7,000 on A (B p. 61, A p. 54), and B's ICT damages run in addition to $2,500-an-hour lane closure damages. On A, ICT No. 1 is met only after testing and Town acceptance.

Ask the Town before the Nov 20 question deadline.

Basis of award · Force account

Labor and equipment rates decide the award only on A

On A, the rate schedule is extended by 1,600 estimated hours and added to the Total Base Bid (A p. 10): $5 per hour lower means an $8,000 lower evaluated total. On B, extra work is paid as force account under the NCDOT Standard Specifications; on C, rates are submitted but not evaluated.

Price the rate schedules differently on A and C.

Method

  1. The three front ends were split into provisions by section number and heading and matched against the Town's 2025 contract template.
  2. The text of each provision was compared across A, B and C after normalizing spacing, date formats and cross-references.
  3. Differences were classed as project data (names, dates, locations, sheet numbers), wording (same meaning) or substantive (a different requirement, time, amount or risk).
  4. Substantive differences were assessed against the Town's General Conditions and our estimate, with the effect on the bid and an action.
  5. The timeline uses the Contract Time, Intermediate Contract Time, Liquidated Damages and Early Completion Incentive provisions.

Assumptions and limitations

  • Liquidated damages are calendar-day amounts and assume the same delay for ICT No. 1 and completion. Lane closure damages on B are not included.
  • Notice to Proceed on C is assumed to be Jan 18, 2027 unless changed.
  • Whether a difference is substantive is an estimating and contract judgment. Questions of interpretation should go to the Town before the question deadline.
  • Plans, technical specifications and bid schedules are outside this comparison.
  • B states that the traffic control plan for NC 410 is approved by the NCDOT District Engineer. Depending on the type of encroachment agreement, final approval may rest with the Division Engineer; confirm with the NCDOT division office before lane closures are scheduled.
